Domain Name
Registration Terms
* Please note it can take
up to 48 hrs for a newly registered domain name to resolve or
propagate on the internet. If your domain name has not resolved you
can not log in to your web hosting cpanel using your domain name. You
should be able to log in using your IP address.
* We have no control over
how fast your domain name resolves on the net after it's registered.
We will not give refunds in the event you can't wait the maximum
amount of time that your registrar states that it will take your
domain to fully propagate.
* Domain names are included
for free for the first year in all the web hosting packages. You are
responsible for paying the $15.00 per year domain renewal free to
Techbydesign in addition to your yearly web hosting renewal fee after
the first year of service.
Web Hosting Terms
* Your web hosting account
will be renewed yearly.
* Domain names MAY BE included
for free for the first year in all the web hosting packages. You are

Techbydesign in addition to your yearly web hosting renewal fee after
the first year of service.
* You can use a previously
registered domain name with your web hosting account if you wish, if
you already own one.
* You will get a payment
reminder when your account is due at least 1 month in advance.
* If you do not renew your
web hosting acct at the end of your contract, we request that you let
us know before your account is suspended. This will save so much
trouble. If you account goes in to suspension you will not have
access to any of your files unless you pay your bill. So it is best
to be straight forward and upfront.
Web Design Terms
*We only offer web design by requests only.
*
½ of the total amount for web design is required to be paid
down before any work begins on your web site.
* Once the web site is
complete and suits you, the other ½ of the amount is due
before the web site goes live.
* Your contract time will
not begin until your web site is 100% completed. In other words if I
start in April and your site is not completed until May, then your
time starts in May. Your web site contract will renew 1 year from
that date.
* Web hosting is included
in all my web design packages as well as promotion, updates, and
domain name.
* I do web design contracts
on a per client basis. Before any work begins the client and I will
agree on the terms of the contract. We will touch base on what the
client expects and what I can provide. We will set a estimated time
for completion.
* I/Techbydesign reserve
the right to charge extra for any unreasonable amount of work that
the client requires that was not agreed on or added at a later date.
* Your account will renew
on a yearly basis. Your renewal along with your domain name renewal
fee of $15 will be due at the end of your contract.
* Please make sure you read
all of the TOS because all of the TOS applies.
Web Site Promotion
Terms
* We only offer web site promotion on a per request basis only!
* Once I start working on
the marketing and promotion of your web site it can be up to 3 months
before you see good results. It is a building process.
* I promise my clients at
least a top 10 listing within 90 days in the major search engines
using phrases that relate to your business/web site.
* The web site will be
search able via short phrases.
* I will promote your site
to hundreds of search engines each month.
* Web site promotion
contracts renew yearly.
* I make no promises that
people will buy your products. I can get them to your site, but I can
not force them to buy. I will not be held liable for lack of sales at
your business or your web site.
Products &
Digital Downloads Terms Of Service
* We are not responsible
for any damages incurred to your computer, hardware or any device
connected to your computer due to using or downloading any of our
digital products.
* We accept no
responsibility for how you choose to use the web site templates,
graphics or any other digital downloads that we sell on our site.
Some of the products have TOS included from the creators of the
products. You are responsible for following their rules and TOS for
each product.
Internet Terms Of
Service
* I/Techbydesign
will not be held responsible for any damages to you or your computer
or any devices connected to your computer, after downloading Localnet
dial up internet service. This applies if you download the service
from the internet or via a disc supplied by me.
* I do not offer support
for Localnet internet service in any way shape or form. I can install
the service for you if you are local at no charge, but as far as any
technical support you will need to deal directly with Localnet.
Liability
*We are not responsible for
any conflicts of any 3rd party add-ons or additions that
you wish to use on your account added by Techbydesign (on request) or
by yourself. We are not responsible for any conflicts to your
computer or any computer or any hardware or device connected to your
computer. You are accepting and using our services at your own risk.
* Techbydesign gives no
warranty that your account or our servers are hack proof. Honestly
there is no such thing as being 100% hacker proof. Although we take
measures to protect our servers and our customer's accounts, there is
always a small chance some hacker can gain access. If anyone tells
you that something is 100% hack proof they are lieing. You can
protect your account by changing your passwords every few weeks and
selecting a combination of letters and numbers. You can also protect
your account by making sure that all applications or scripts
connected to your account are updated and you are using the newest
versions.
* We are not responsible
for any damages or conflicts to you, your acct, your computer or
devices if your hosting account or website is hacked or compromised.
You are agreeing by completing the sign up for services that you are
using our services totally at YOUR OWN RISK.
* We are not responsible
for any phone charges or any resulting cost to you if your hosting
account is hacked and compromised.
* We are not responsible if
your computer, hardware or any device connected to your computer OR
your account is compromised due to spam. You are responsible for
protecting your self against email spam. There are programs included
in your web hosting acct that can help you combat spam. You can also
use a 3rd party program such as “Spam Arrest”or “Spam
Fighter.”
* We are not responsible
for any damages or cost that occur if your account, computer or any
hardware connected to it is compromised due to your computer being
infected with spy ware or adware. You are responsible for the
protection of your computer, any device or hardware connected to it.
You can use a couple of free anti spyware or anti adware programs to
help combat these issues. You can get Spybot Search And Destroy
or Ad Aware totally free for at home use. These programs must
stay updated and ran on a weekly basis.
Payment And
Suspension Policy
*We/Techbydesign accept
PayPal payments, credit cards for hosting accounts and web design
accounts. We can also process payments over the phone if you have a
major credit/debit card. I request if you are mailing your payments
please make sure you mail your payment in time for it to be in by
your due date. If you suspect that your payment will arrive late
please call me and let me know.
* If Your payment is not in
by your due date, I reserve the right to suspend your account. I
request that if your payment is going to be late that you call me or
email me so I can work out a payment extension for you. I request at
least a few days notice if possible. If you are upfront with me, I
will do my best to be flexible and understanding.
* If your acct is suspended
for non payment or for breaking the TOS we will suspend your acct and
place a page holder notice on your site. The place holder page will
state the fact that your acct is suspended for breaking the TOS or
for non payment. It will state the fact you have 7 days to settle
your account with Techbydesign or your files will be lost forever.Your visitors to your site will not see your website but will be
able to view this page.
* In the event that your
account is suspended due to non payment you will have 7 days from the
date of suspension to settle your acct with me.
* If your acct is
suspended due to non payment you will not be able to gain access to
your account nor will I allow you to collect your web site files
until you pay your account up. I offer an open door policy
and if at any time your payment is going to be late please just tell
me. If you
are upfront with me, I will be will you.
